MHC is issuing Bulletin #20-005 to announce the Temporary Eviction Moratorium Provision of the CARES Act, which was passed into law on March 27, 2020, in response to the COVID-19 pandemic. This Bulletin applies to properties that have received financing through the HOME Program. Recipients of HOME awards must inform tenants residing in HOME Assisted units of the Eviction Moratorium Provision. Recipients are required to post this information for public reviewing on development sites, websites, local news media, and any other means of communication. This information must be maintained in project files to document Affirmatively Marketing Outreach.

The Eviction Moratorium became effective March 27, 2020, and remains effective until July 24, 2020. The Temporary Eviction Moratorium Provision addresses the non-payment of rent for most federal housing programs. It prohibits owners from filing new evictions for non-payment of rent and prohibits charging fees, penalties, or other charges related to non-payment during the 120-day moratorium period. The Act prohibits owners from evicting tenants after the moratorium expires except with 30 days’ notice and further provides that any such notice cannot be given until after the moratorium ends.
